Public Offers
This section of the Capital Builder provides guidance for co-operatives wanting to make a public offer of securities. Co-operatives in all States and Territories are governed by a uniform scheme of laws called the Co-operatives National Law.
For co-operatives in Western Australia, the legislation that is part of the Co-operatives National Law scheme is called the Co-operatives Act 2009 WA. For co-operatives registered in all other States and Territories, it is called the Co-operatives National Law or CNL. Links to both laws are provided.
The lodgement and disclosure requirements for a public offer are similar to the lodgement and disclosure requirements for offers of securities by a company under a prospectus.
For offers of CCUs, there are additional procedural steps required before launching an offer.
