Producer co-operatives

Producer co-operatives are those with members who are producers. Their co-operative takes their product, value adds to it and sells it. This is often the type of co-op used in agriculture. Most, although not all of these co-operatives will be distributing co-operatives.
Type: Distributing
Focus: Ownership of facilities that are used to serve the community
Primary Activity
The primary activities of the Co-operative are:
- to establish and operate accessible, multi-use facilities that are suitable for use by the community and which are available for free or for an affordable cost; and
- to develop and maintain any income-generating activities compatible with and complementary to the activity in rule (a) above to support the Co-operative financially so that the Co-operative can operate sustainably.
Active Membership Requirements
- In order to maintain active membership, each member must:
- pay the regular subscription fee in accordance with rule xx (which money will be used towards the primary activities of the Co-operative); and
- either:
- use the facility/ies at least once every twelve (12) months; or
- volunteer to work a minimum of 2 hours every six (6) months for the Co-operative.
- All members of the Co-operative must be active members.
- Subject to sections [123 and 124 of the Co-operatives Act / 159 and 160 of the Co-operatives National Law], a member who fails to be or stops being an active member must, under the Law, have their membership cancelled.
Type: Distributing
Focus:Producer / Buying group in which members supply or purchase goods or services from the co-operative for use in their own care sector businesses.
Primary Activity
The primary activities of the Co-operative are to:
- acquire products used in the Care Services sector generally, or by Care Services providers specifically, for disposal or distribution amongst the members;
- provide services to members (including shared back-office administration, provision or workers or contractors, and other services needed from time to time); and
- to offer the same goods and services (referred to in rules (a) and (b) above) to non-members on a commercial basis.
Active Membership Requirements

- purchase products or services (of the kind listed in rules x(a) and (b) above) from the Co-operative; or
- supply goods to the Co-operative (of the kind listed in rule x(a) above or other goods or services sought by the Co-operative),with a minimum value of $1,000 plus GST within a rolling twelve (12) month period.
OR
- [Alternate drafting outside of NSW] In order to maintain active membership, each member must:

- purchase products or services (of the kind listed in rules x(a) and (b) above) from the Co-operative; or
- supply goods to the Co-operative (of the kind listed in rule x(a) above or other goods or services sought by the Co-operative)
with a minimum value or volume (if any) determined by the Board from time to time, and within a rolling twelve (12) month period
All states:

- All members of the Co-operative must be active members.
- Subject to sections [123 and 124 of the Co-operatives Act / 159 and 160 of the Co-operatives National Law], a member who fails to be or stops being an active member must, under the Law, have their membership cancelled.
The following word has a special meaning for the purposes of the primary activities and active membership requirements:
“Care Services means aged care, disability care and/or health services”.
Type: Distributing – NSW
Primary Activity
The primary activities of the co-operative are:
- The storage, handling, transportation, packing and processing of agricultural commodities on behalf of co-operative members;
- The provision of other services to assist the co-operative’s members;
- To undertake research and development activities related to the grain industry; and
- To promote the Australian grain industry.
Active membership
In order to establish and maintain active membership of the co-operative a member:
- Who is the owner or occupier of land must deliver or trade no less than 100 tonnes of grain grown on the member’s land in one (1) financial year or a cumulative rolling total of 300 tonnes of grain grown on the member’s land over three (3) financial years for sale through the co-operative’s storage facilities;
- Who is a grain buyer must deliver or trade no less than 100 tonnes of grain in one (1) financial year.
“Grain” means wheat, barley, oats, canola, sorghum, chick pea, field pea, cotton, lupins or any other grain.

Primary Activity
The primary activities of the co-operative are the acquisition of commodities or animals, from members for disposal or distribution as value added products.
Active membership
In order for a member to establish and maintain active membership of the co-operative the member must deliver, or cause to be delivered, to the co-operative during any immediately preceding period of 24 months, the commodities which the Co-operative requires for the purpose of its business.

Type: Trading – Qld
Primary Activity
The primary activities of the co-operative are:
- Buying produce from members,
- Providing facilities or arrangements for the processing of such produce,
- Marketing, storing and transporting produce for members,
- Developing standards for farmers dealing with animal welfare, ecological balance, environmental protection and sustainability, and
- Developing training or educational materials and programs for farmers and consumers.
Active membership
In order for a member to establish and maintain active membership of the co-operative the member must do at least one of the following:
- Sell or deliver a minimum of $300 worth of produce to the co-operative or to a place that the co-operative has nominated,
- Attend or host a training program offered by the cooperative,
- Provide volunteer help to the co-operative for a minimum of 1 hour each month
For the purposes of the primary activity and active membership rules produce includes any meat, being beef, lamb, pork or chicken, eggs and other similar products grown by the member on land owned, leased or otherwise managed by the member.
